On Wednesday, January 16th, during the meeting of the Vytautas Magnus University (VMU) Rectorate, Ms. Justina Gabrielaitytė, the student of the Faculty of Law, was awarded the memorial scholarship of Nordia Baublys & Partners, the Professional Partnership of Advocates.During the meeting Mr. Marius Endzinas, the representative of Nordia Baublys & Partners said that the partners of the partnership were the graduates of VMU, thus they were proud to be able to cooperate with their alma mater. “We feel part of this family – not only because of this incentive, awarded to the most exceptional students of the Law of Faculty, but also because we share a common approach to life. I believe that namely this university forms a person, who has his/her own distinctive approach to what is going on around him/her”, stated M. Endzinas.This is already the third such scholarship, awarded to the future lawyers by Nordia Baublys & Partners. Attorney at law Marius Liatukas successfully represent a Client in a case regarding a dispute arising out of contract. The court dismissed the claims of the applicant directed against the Client and rejected the application.
Advocate Marius Endzinas at Lithuanian Court of Appeals successfully represented a company who won a public tender. The Court completely dismissed all claims by the competitor who lost the tender. The Court upheld the decision (in favor to the Client of NORDIA BAUBLYS & Partners) ruled by the Klaipėda Regional Court and based its judgment on the same reasoning as in position of NORDIA BAUBLYS & Partner’s Client.

Advocates Dalia Stakvilevičiūtė and Marius Endzinas successfully represented Client-Person at Lithuanian Court of Appeals. The Court dismissed prosecutor‘s appeal on the Šiauliai Regional Court‘s decision in favor of the Client. Prosecutor‘s claim was based on the defence of public interest and involved a prosecutor‘s request to declare a building sale contract (signed between the Client and Šiauliai city municipality) void. The posecutor also requested and order to make restitution. After the prosecutor‘s claim (including appeal) was dismissed, the buiding (which is a cultural heritage site) in question stays a property of the Šiauliai city municipality. It means that the project to establish Šiauliai art incubator (project worth 8 millions Litas is financed from EU funds) in the same buidling will be able to continue.

Associate lawyer Darius Bačinskas successfully represented the Client (the interests of the natural person) at Klaipėda Regional Court in the case instituted on the basis of the Client’s claim filed against the company under bankruptcy and other respondents regarding the invalidation of the ownership rights to the flat and invalidation of the transactions. By upholding the arguments and the evidence collected by NORDIA BAUBLYS & Partners the court recognized the Client’s ownership rights to the unfinished flat, invalidated in part the sale-purchase agreement concluded by the company under bankruptcy regarding the sale of the flat owned by the Client, reclaimed the flat from the unlawful owner and returned it to the legitimate owner, i.e. the Client of NORDIA BAUBLYS & Partners.

On 8 November 2012 BAUBLYS & Partners Attorney at law Rūta Didikė attended the roundtable discussion “Election 2012”, organised by the Lithuanian Lawyers’ Association Vilnius Division. Attorney at law Marius Liatukas successfully represented a Client at the Šiauliai Regional Court in a case regarding public procurement. The Court rejected the application of the applicant and upheld that the Client was entitled to include a prohibition for a supplier undergoing restructuring to participate in a public procurement into the terms and conditions of the procurement documents.
On 25-26 October, 2012 NORDIA BAUBLYS & Partners Attorney at law Rūta Didikė attended the Baltic Investors Forum, which was held in Vilnius. The speakers of the Forum were the well-known economists, such as Mr. Lars Christensen, the Chief Economist at Danske Bank and Mr. Richard C. Attorneys-at-law Marius Liatukas and Marius Endzinas successfully represented a private limited liability company and its director at Kaunas Regional Court in a criminal case on contraband of strategic goods. The Clients of NORDIA BAUBLYS & Partners were accused of smuggling demilitarized armour-plated transporter and two trucks into Lithuania after these were bought in public auction in the United Kingdom. Both accused were discharged by he Court completely on the grounds that there were no deliberate actions to do an offence found and also on the grounds that legal requirements regulating the movement of particular goods in EU became more lenient. After the judgement becomes final, all the confined equipment must be returned to the company.

Attorney-at-law Marius Endzinas successfully represented a Denmark-based international construction company at Panevežys district court in a civil case on public procurement results. As NORDIA BAUBLYS & Partners Client won EU-funded public tendering announced by Pasvalys district municipality, one of the competitors challenged the results in court. The court dismissed the action finding that procurement procedures were carried out without violating the laws and the Client had proper qualifications as well as offered the lowest price, therefore he validly won the tendering.

Partners Gediminas Baublys, Kęstutis Švirinas, Evaldas Rapolas and advocate Marius Endzinas successfully represented Client-Person at the Vilnius Regional Court. The case involved the shareholders and the company who requested 76 million Litas compensation from the general manager for the damages he has caused for the company. Court agreed with Clients advocates’ arguments, which were stated in the procedural documents, and the provided evidences and cancelled out more than 99 percent of the requests. The Court also stated that the most important decisions of the company were done by the board. Moreover the situation revealed that the general manager couldn’t be the main cause of the million Litas damages done to the company because he was always groomed by the shareholders delegated person.

The court agreed with the Clients advocates’ arguments and renewed the pre-trial investigation against one of the biggest medical institution doctors’ for breaching official duty.

Attorney-at-law Albertas Šekštelo successfully represented the Client – a company engaged in performance of construction design expert examinations - at Vilnius Regional Court during the hearing of the case related with the recovery of the loss in the amount of 1,6 million LTL. The Client, the designer and the insurance company were included in the case as the Respondents. The Plaintiff claimed that all Respondents be jointly and severally liable for recovery of the loss. However, in its Order the Vilnius Regional Court established no causal relationship between the loss incurred by the Plaintiff and the Client’s acts as a result of which the Client’s liability was not determined.

By its Order the court upheld the ruling on the award of the advance payment from the Municipality rendered by the court of the lower instance.

Attorney-at-law Albertas Šekštelo successfully represented the Client – a Lithuanian company – at the Lithuanian Court of Appeals during the hearing of the civil case regarding recognition of the Ruling rendered by the Arbitral Tribunal of Sankt Peterburg and Leningrad Area of the Russian Federation and permission to enforce it on the territory of the Republic of Lithuania. Upon examination of the supplementary evidence collected and submitted to the court by the Client‘s Attorney-at-law, the Lithuanian Court of Appeals referred to violations of the provisions of international laws and refused to recognize and grant permission to enforce the Ruling of the Russian court on the territory of the Republic of Lithuania.

Partner Evaldas Rapolas and associate lawyer Kęstutis Baranauskas successfully represented client interests in the Court of Appeal of Lithuania. The case involved the dispute between the general manager (Client) and the company shareholders. The company shareholders requested the client to compensate the damages that he has done to the company. The Court of Appeal of Lithuania agreed with Nordia Baublys & Partners arguments which were noted in the claim and other litigation process documents and set aside the first instance decision which stated that more than 1,5 million litas has to be covered from the client and other related persons. The Court also decided to return the case back to the first instance for a new case examination.
On 26 April 2012 Partner Kęstutis Švirinas and Lawyer Jonas Sakalauskas successfully represented the interests of AB “Lietuvos geležinkeliai” in the oral court hearing at the Court of Justice of the European Union (Luxemburg), in the case on prejudicial judgment passing in relation to application of value-added tax concessions for railway transport.

Kęstutis Švirinas also successfully represented one of the largest engineering network companies in Lithuania in criminal proceedings. The company was indicted for crimes against the tax system. The criminal proceedings, during which the case was heard twice at the Lithuanian Court of Appeal and the Supreme Court of Lithuania, lasted for eight years. According to the application of Kęstutis Švirinas, the Lithuanian Court of Appeal referred to the Constitutional Court of Lithuania regarding the constitutionality of norms regulating the application of criminal liability to legal entities. In the spring of 2011, the Lithuanian Court of Appeal fully acquitted the company and on 14 February 2012, the Supreme Court of Lithuania discontinued the cassation proceedings, thus leaving in effect the exculpatory judgment.

Lawyer Albertas Šekštelo and his assistant, Eglė Bučinskaitė, successfully represented the interests of one of the largest printing houses in Lithuania in a case regarding debt adjudication from the printing house’s client, including the adjudication of losses sustained subsidiary to this by the company’s shareholders. This was based on the liability of the latter for their unfair actions in transferring the company’s activity to a newly incorporated company, thus avoiding return of the debt to the printing house (the so-called “phoenix syndrome”). An amicable agreement was reached in the case between the parties, after the defendants acknowledged, in essence, all the requirements made in the printing house case.

The lawyer, Marius Liatukas, won the case, representing the interests of NORDIA BAUBLYS & Partners’ client. The merit of the case – a Japanese company, referring to the patent, applied at the Vilnius Regional Court, asking to forbid NORDIA BAUBLYS & Partners’ client to import and sell wire reels used in the construction industry. The Vilnius Regional Court ignored the application of the Japanese company against the firm’s client, acknowledging that the firm’s client had carried out an economic activity in a lawful way, and without violation of the patent. The Court also ignored the request of the Japanese company on an adjudication of damage.

By its Order passed on 2 May 2011 the Supreme Administrative Court of Lithuania satisfied the Client’s claim and revoked the Ruling passed on 22 July 2010 by the Vilnius Regional Administrative Court, by which the said Court had revoked the Decision of the Tax Disputes Commission that had been favorable to the Client. By its Decision the Tax Disputes Commission had stated that the State Tax Inspectorate had groundlessly calculated more than 300 thousand LTL of VAT and more than 120 thousand LTL of the default interest to be paid by the Client and had groundlessly imposed a fine in the amount of more than 30 thousand LTL. By its Order passed on 2 May 2011 the Supreme Administrative Court of Lithuania stated the Vilnius Regional Administrative Court had made certain violations while hearing the case and ordered rehearing of the case.

This programme included evaluation of energy efficiency of buildings and modernization opportunities thereof; evaluation of modernization effects on the heat production and supply system; legal framework analysis and drafting of necessary legislation; preparation and presentation of the draft programme and arrangements for implementation thereof. It is expected that the implementation of the “Visagino Enervizija” Programme will allow for improvement of technical and energy qualities of apartment buildings and ensuring that heat energy consumption does not exceed necessary consumption depending on local climatic conditions and needs of the residents. The scope of the Programme is expected to include modernization of all apartment buildings in Visaginas City.

Albertas Šekštelo, attorney at law at the Professional Partnership of Advocates NORDIA BAUBLYS & Partners, successfully represented a client in the case regarding decisions by a police authority to fine the client with revocation of the driver’s licence for an allegedly dangerous driving. During case hearing the attorney sought for the collection of additional evidence which raised substantiated doubts to the court regarding validity of the decision by the police authority. After prolonged litigation in courts the Supreme Administrative Court of Lithuania annulled the decision of the police authority and closed the case.
